Statute of Limitations

Statutes of limitations re predetermined time periods in which you may file a claim with the Court. Most, but not all, Personal Injury claims carry a two-year statute of limitations beginning from the date of the accident, however, some claims may be less. So if the accident occurred on March 1, 2004, your statute of limitations would be February 28, 2006 after which time you would be barred from ever filing your claims with the Court. However, if the injured party is a minor, the statute of limitations does not begin to run until the minor's 18th birthday. The statute also varies if a plaintiff seeks recovery from a public entity such as a municipality, state or federal institution, or a hospital. In that instance, specific notice must be given to the entity within 90 days.
